Item type: Item , العلوم الإنسانية، خطرة وفي خطر(AL-MUKHTAR JOURNAL OF SOCIAL SCIENCE, 2021-06-30) عمران, عبدالله عليتهدف هذه الدراسة، إلى تبيان واقع العلوم الإنسانية، من خلال عرض ما يجب أن تؤديه من وظائف، وما يعترضها من عوائق، تحول بينها وبين تأدية وظائفها، وذلك من خلال منهج تاريخي متتبعا نشأتها وتطورها عربيا وغربيا، ومنهج مقارن للمقارنة بين ما وصلت إليه عربيا وغربيا، ومنهج تحليلي للوقوف على أهم الفوارق بين النموذجين العربي والغربي، حيث يتبين الفارق الشاسع بين ظروف النشأة ومراحل التطور بينهما، والذي يعود أساسا للفارق الشاسع والنوعي في الإشكاليات وكيفية طرحها و محاولة حلها، لكون الإشكاليات في الفكر الغربي ذات طابع علمي، بينما واقع العلوم الإنسانية عربيا، تسيطر عليها المشكلات الاجتماعية والسياسية والدينية. This study aims to clarify the reality of the human sciences, by presenting the functions it must perform, and the obstacles that prevent it from performing its functions, through a descriptive historical approach that traces its origin, Arab and Western development, and methodology. A comparison between what the Arabs and the West have reached, and an analytical approach to find out the most important differences between the Arab and Western cases, as the vast difference between the conditions of emergence and the stages of development between the two cases becomes clear. Which is mainly due to the large and qualitative difference in the problems and how they present and try to solve them, because the problems of Western thought are of a scientific nature, while the reality of the human sciences in the Arab world is dominated by social, political and religious problems?Item type: Item , الحيازة وأثرها في الملكيَّة(AL-MUKHTAR JOURNAL OF SOCIAL SCIENCE, 2021-06-30) الحمزية, مفتاح فرج عبدالسلامالحيازة من الأمور المهمة التي تحتاج إلى مزيد من البحث لما لها من تأثير في الملكية، وهذا البحث حاول أن يدرس هذا المصطلح ببيان مفهومه، وتأثيره في نقل الملكية، مع ذكر المدة المؤثرة في ذلك، ويسرد أقوال الفقهاء مع أدلتهم، وبيان الراجح منها، وما هي الأمور التي تجعل لصاحب الحق المطالبة بحقه حتى بعد مضي المدة؟ والنقطة الأهم في هذا البحث هو ربطه بقانون رقم 123 لسنة 1970 م في شأن التصرف في الأراضي الزراعية والمستصلحة المملوكة للدولة الصادر عن مجلس قيادة الثورة آنذاك، والذي مكّن المنتفعين من امتلاك تلك الأراضي، وحرم منها أصحابها، وبيان مخالفته للشريعة. Possession is one of the important matters that need more research because of its impact on people's ownership. Thus, this research aims to study this term by clarifying its concept and effect on the transfer of ownership, along with mentioning the period affecting it, and listing the sayings of the Fish jurists with their evidence, as well as the widely accepted opinion. The research discusses the matters that make the right holder claims his right even after the period has passed. The most important point in this research is to link it to Law No. 123 of 1970 AD regarding the disposal of agricultural and reclaimed lands owned by the state of the Revolutionary Command Council at the time. It enabled the beneficiaries to own these lands, deprived their owners of it, and demonstrated its violation of the Sha-ria.
